Global shipping companies are turning to Brazil’s legal system to challenge regulatory restrictions preventing them from participating in the initial bidding round for a major new container terminal at Latin America’s largest port the Port of Santos. The first phase of bidding for the Tecon 10 terminal is scheduled to take place later this year.

Danish shipping leader Maersk (MAERSKb.CO) has filed a lawsuit in São Paulo against Brazil's marine transport authority Antaq and its general director. According to legal documents reviewed by Reuters, the company is demanding “procedural corrections to ensure a fair process” in the awarding of the strategic terminal.

The Port of Santos plays a critical role in global supply chain management, and the Tecon 10 terminal is expected to be a key asset in enhancing Brazil’s maritime logistics capabilities. The current competition rules, however, bar major global shipping groups from participating in the first round, prompting legal pushback from some of the industry’s biggest players.

This dispute underscores broader tensions in the global supply chain industry, where infrastructure access and regulatory transparency are becoming increasingly vital. As the legal challenge unfolds, industry stakeholders are closely watching for implications on the future of supply chain management in emerging markets.
